The Court of Justice of the European Union has notified in writing its Chamber judgment in the case of European Air Transport SA v Collège d’environnement de la Région de Bruxelles-Capitale and Région de Buxelles-Capitale. The Court considers that the Member States can, theoretically, establish maximum noise levels, as measured on the ground, to be complied with by airlines overflying areas located near an airport.
However, if such legislation has the effect oforcing airlines to forgo business operation, it can only be adopted in accordance with conditions |
